“Over the past several years, the Ministry of Justice has been dedicated to improving judicial efficiency which has largely been achieved with the unburdening of the courts by way of transferring non-trial cases to public bailiffs and notaries”, Minister of Justice Nela Kuburović has stated at the “Fifth Lap Time – Reforms in Fifth Gear” Conference organised by the American Chamber of Commerce in Serbia. She emphasised that 1.7 million of old enforcement cases had been finalised since the application of the new Enforcement and Security Act, adding that in one year 150,000 cases of extra-judicial and probate matters had been directed to public notaries. “We will continue to proceed in this fashion”, the Justice Minister stated, explaining that the Ministry had indeed been working on the advancement of alternative means of dispute settlement and, on the occasion, inviting entrepreneurs to use mediation as means of settling disputes as it was the fastest, the most efficient and least costly way. She noted that in an effort to advance judicial efficiency, the Ministry had also been working on improving the e-court and infrastructural capacities of judicial organs, as well as the electronic data exchange.

Kuburović said that the focus in the following year would be on the fight against corruption, with the new Organisation and Competencies of Government Authorities in Fighting Corruption, Terrorism and Organised Crime Act coming into force on 1 March 2018. She explained that the Act would introduce an entirely new organisation of courts and prosecutors’ offices in terms of combatting crimes of corruption.

She added that when conducting legislative activities, the Ministry of Justice was considering the views of the citizens and the community of commerce experts, particularly the American Chamber of Commerce. Kuburović referred to the Enforcement and Security Act as one of the good examples of cooperation between the Ministry of Economy and the American Chamber of Commerce.
