“The Ministry of Justice has introduced the E-Court application which enables attorneys and citizens to initiate administrative lawsuits electronically, including exchange all motions with the court through the application”, Minister of Justice Nela Kuburović stated today. While visiting the Prijović, Đasić and Gerasimović Law Firm to witness on the spot whether the new application was working, the Minister said that using the application was not yet mandatory and explained that the application was a pilot project which was first being tested with the Administrative Court. “This primarily means time and cost saving for both the court and the litigating parties. We are commencing with the Administrative Court, but starting January, the application will cover the commercial courts because commercial entities are the ones nowadays using certified electronic signatures the most, which are required for the application to be used“, the Justice Minister explained.

He added that the objective of the Ministry of Justice was to initiate the E-Court application in all the courts in the next period. The application was first launched in the Administrative Court which was exceptionally backlogged, processing tens of thousands of cases annually, and where facilitating trials within a reasonable time was incredibly important. “This way, we are speeding-up the proceedings, we are saving time, we are shortening the procedures conducted by the court’s clerk’s office and we are reducing the costs of mail“, Kuburović noted.

The Minister added that the new application was available to the citizens and the courts, which meant that every court case filling would be shared electronically and, consequently, would save citizens the time as there would no longer be a need for the printing of volumes of paper. Kuburović also noted that E-Court enabled litigating parties who may not be at their registered residential addresses or who find themselves abroad to use the application and file the relevant motions with the court in a timely manner.

“Furthermore, all parties’ filings and court decisions will be scanned in the application, allowing the parties electronic access to the case files without having to schedule appointments with the court and go to the court. With that, transparency of the courts’ work will also increase. With this application in place, the litigating parties will only have to present themselves in court in case of hearings”, the Minister explained.

Vladimir Prijović, attorney-at-law, invited all colleagues to use the new application, noting that one of its main advantages for the attorneys was the possibility of an easier access to case files without any appointment scheduling, receipt of court decisions and filling of lawsuits at any moment without having to leave the firm. “Time is needed for everyone to get used to the application. I believe that once it is introduced in the commercial courts, the number of users will increase considerably“, Prijović stated.
